Expert witnesses' testimonies hold immense weight in Austrian courts. As opposed to many other countries, private experts are not allowed to testify in Austrian main trials, only experts ordered by the court can give an opinion. Wrong assessments by insufficiently qualified experts, however, can have enormous consequences.
"Expert Witnesses – The True Judges" shows the case of a severely disabled 11 year old girl, who does not receive compensations as a "vaccine victim". An expert recognizes the vaccine damage, as a private expert, however, his testimony is not admissible.
Christian Wagner is accused of murdering his wife. His claim that she jumped off a balcony is declared impossible by an expert ordered by the court. Due to this testimony, Wagner is ordered to 13 years in jail. Now, seven years later, two independent institutions declared the first expert's opinion for flat wrong.
Dr. Richard Soyer, speaker of the Austrian Defence Lawyer's Union, has been demanding reforms for years. He says that mistakes happen in "expert" testimonies on the regular. Only experts from the specific fields of study could reveal these mistakes to the court. Judges, however, oppose this change.
